Decision on Proclamation of Independence of the Republic of Montenegro

At its inaugural Session on Saturday evening June 3rd, 2006 8:00pm, in the presence of President Filip Vujanovic, Prime Minister Milo Djukanovic and members of his cabinet, resigning President of the State Union of Serbia and Montenegro, Svetozar Marovic, high representatives of the judicial power, the emissary of the European Parliament, Jelka Kacina, the Parliament of Montenegro has adopted the Decision on Proclamation of Independence and the Declaration of the Independent Republic of Montenegro , both signed by the President of the Parliament, Ranko Krivokapic, confirming officially the will of the Montenegrin People that the Sovereignty of their country be restored. After the Session be opened by playing the Montenegrin National Anthem, “Oj, Svijetla Majska Zoro”, the President of the Republic Referendum Commission, Slovak Diplomat Dr. František Lipka, submitted to the Assembly his report on results of the 21 May Referendum, and congratulated the Montenegrin People for having voted during the Referendum in peace and with dignity.
41 of the 74 Deputies of the Montenegrin Parliament from the Democratic Party of Socialists (DPS; governing parties), the Social Democratic Party (SDP; governing parties), the Liberal Party (LP; pro-independence opposition parties), the Citizen’s Party (GS; pro-independence opposition parties), the Union of Albanians (DUA; Albanian minority parties) and the Democratic League of Montenegro (DSCG; Albanian minority parties) have voted for the Decision on Proclamation of Independence of the Republic of Montenegro and for the Declaration. Deputies from opposition parties — Socialist People’s Party (SNP), Serbian People’s Party (SNS), People’s Party (NS) and Democratic Serbian Party (DSS) — did not assist to the Session, nor those of the Liberal Alliance of Montenegro (LSCG), party which has postponed its political action. Ranko Krivokapic closed the half an hour-long Session, by the words: “That Montenegro be eternal! Once and for all!”, before be played another time the National Anthem and hoisted up the Montenegrin National Flag in front of the Parliament House in the presence of several hundreds of friendly and enthusiastic citizens chanting “Imamo državu! Evviva Montenegro!”


Implementing the decision based on the free will of the citizens of Montenegro to restore the Independence of the State of Montenegro, and its is through the Referendum held on May 21, 2006, organised in partnership with European Union and verified by the Report of the Referendum Republic Commission which monitored the Referendum of State-Legal Status of the Republic of Montenegro, and exercising the right stipulated in the art. 2 of the Constitution of the Republic of Montenegro and art. 60 of the Constitutional Charter of the State Union of Serbia and Montenegro,

On the basis of art. 81 para. 2 of the Constitution of the Republic of Montenegro, the Parliament of the Republic of Montenegro adopted at its Session on June 3rd, 2006:

THE DECISION ON PROCLAMATION
OF INDEPENDENCE OF THE REPUBLIC OF MONTENEGRO

1.— The Republic of Montenegro is an Independent State with full international legal personality within its existing state borders.

2.— The Republic of Montenegro, by restoring its Independence, shall assume all matters that it had conferred on to the institutions of the State Union by adoption of the Constitutional Charter of the State Union of Serbia and Montenegro.

3.— The Republic of Montenegro shall apply and adhere to International Treaties and Agreements that the State Union of Serbia and Montenegro was party to and that relate to the Republic of Montenegro and are in conformity with its legal order.

4.— Pending adoption of respective regulations of the Republic of Montenegro, regulations that were effective as regulations of the State Union of Serbia and Montenegro on the day of the entry into force of this Decision shall apply as the regulations of the Republic of Montenegro, provided that they are not in collision with the legal order and interests of the Republic of Montenegro.

5.— The Republic of Montenegro shall determine the procedure of assuming the matters that have been so far administered by the institutions of the State Union of Serbia and Montenegro and by separate acts of the Parliament and the Government of the Republic of Montenegro is shall establish and make public the principles upon which its internal and foreign policy shall be formulated and conducted.

6.— The present Declaration enter into force on the day of its adoption and shall be published in the Official Gazette of the Republic of Montenegro.
